In this issue find details on the following:

1.  Accident Registers are required for all motor carriers operating commercial motor vehicles over 10,000 lbs MGVWR! 

  • Definition of an Accident: According to the FMCSA, any CMV >10,000lbs MGVWR, HM or Passengers operating on a highway that results in a fatality, bodily injury requiring medical treatment, or one or more vehicles incurring damage requiring transportation away from the scene by tow truck or the like.
  • Accident DOES NOT include: An occurrence involving only boarding and alighting from a stationary motor vehicle, or an occurrence involving only the loading or unloading of cargo.

When an accident does occur, it is required to be recorded on an accident register with the following information:

  • Date of accident
  • City or town, or most near, where the accident occurred and the State where the accident occurred
  • Driver Name
  • Number of injuries
  • Number of fatalities
  • Whether hazardous materials, other than fuel spilled from the fuel tanks of motor vehicle involved in the accident were released

Accident registers are required to be kept for THREE years after the date of each accident.  It is also recommended as a best practice that both DOT recordable accidents and Non-DOT Recordable accidents are maintained on 2 separate accident registers each year.  They can be kept electronically with a hard copy printed upon request for the FMCSA.

2. Did you Register your company for the new Drug and Alcohol Clearninghouse for CDL Drivers?

  • Registration is open - Register NOW for access and receive additional information, a fact sheet, implementation timeline and FAQs.
  • Don't forget to sign up to receive clearinghouse-related updates during the implementation process!
  • Starting 1/6/20, you MUST query the Drug and Alcohol Clearinghouse as part of your pre-employment driver investigation for eligibility.
  • Follow the annual query requirement and query ALL drivers with a CDL to determine driver eligibility and any unresolved DOT drug and alcohol violations.

FMCSA defines 2 types of queries: Limited and Full. A flat fee of $1.25 is charged for every query, or carriers may purchase an unlimited bundle plan for $24,500/year.

  • Limited: checks for the presence of information in the queried driver's clearinghouse record and requires driver consent outside of the database
  • Full: discloses to employers and designated C/TPAs detailed information about any resolved or unresolved violations in a driver's record and requires a driver clearinghouse account to provide the driver's consent via the portal.

3. FMCSA Increases random drug testing rate to 50% from 25%

  • Beginning 1/1/20 the agency must increase the minimum annual random testing rate when data received indicates the reported positive rate is equal to or grater than 1%
