In this issue:

  •  How does the FMCSA address the use of a driver by multiple employers? While it can get confusing with part time drivers falling in multiple categories, learn about the driver qualifications and requirements of each.
  1.   Multiple-employer drivers by definition, are employed or are used by more than one motor carrier within a 7 day period.  This also applies to drivers that work PT for 2 or more employers on a regular basis.  Read the requirements of motor carriers here.
  2.  Drivers who regularly work for a motor carrier and occasionally work for another.  Read about the certificate required.
  3.  An employee of a non-motor carrier who drives occasionally or part time for a motor carrier - it is in the best interest of a carrier to require all drivers that operate a commercial motor vehicle to complete full qualification.
  • How do Drug and Alcohol testing regulations address a shared driver? 
  1.  Regulations apply to CMV drivers that operate vehicles in excess of 26,000 lbs GVWR or are transporting HM in placardable quantities or passengers.
  2. Best practice : administer pre-employment drug screen to all new drivers regardless of their driver classification.
  3.  Random testing: driver must be in the pool of each employer that the driver works for
  • How do Hours of Service regulations apply to shared drivers? 
  1.  Drivers shall submit a copy of the record of duty status to each motor carrier when services are used by more than 1 motor carrier in a 24 hr period
  2.  When using a driver for the 1st time, or intermittently, motor carriers shall obtain a signed statement of total time on duty throughout the preceding 7 days.
  • FMCSA Drug and Alcohol Clearinghouse Query Plans available for purchase: this enables motor carriers and designated consortia/3rd party administrators to conduct electronic checks (queries) for all current and potential new employees.  These plans can be purchased on the FMCSA Clearinghouse website and bundles will be offered. Otherwise, a flat fee of $1.25/ each limited or full query will be charged.
  • Preventing Driver injuries in fall and winter: slips and trips are the most common types of injuries throughout colder months. Working in snow and ice requires extra attention. Remember:
    • Wear proper footwear with a rugged non-slip sole
    • SLOW DOWN
    • Watch where you walk
    • Take small steps and check footing
    • Look for ice - on ground and on handrails
    • Always wear gloves
    • Always use a seat belt
  • Driver files lawsuit against CBD oil manufacturer for failed drug test - driver ate product that was advertised to contain no THC and was later terminated after failing a DOT drug test.
